Commercial Mediation

Commercial mediation is an alternative to formal dispute resolution such as litigation. A commercial mediation will permit each party to ensure the confidentiality of a dispute and will also, preserve relationships.

Commercial mediation can be arranged at the premises that we utilize or at an alternative venue. Each party will sign a mediation agreement which sets out the process, including confidentiality and the mediator’s fees. From there, the mediator will ask each party to canvass the pertinent issues. After this process, the parties are generally separated and the mediator will caucus between the parties, attempting to facilitate a settlement between both sides.

Commercial mediations can also be held virtually on online platforms such as Zoom and/or Teams. It is also beneficial to consider a mediation parallel to any commercial litigation process. A successful mediation can substantially cut costs and the stress of litigation, including cross examination. It also preserves confidentiality because the dispute is not aired in a publicly accessible court.
